UK earned settlement: how the new route to indefinite leave to remain may work

United KingdomSettlementPolicy updates

The UK government has set out plans to move from a largely time-based route to settlement towards an "earned settlement" model. Details are still evolving, so this guide separates what is known from what is not.

The idea

Instead of qualifying for indefinite leave to remain (ILR) after a fixed period such as five years, applicants would earn the right to settle by meeting contribution-based criteria. Those could include income, work history, language ability, and conduct such as a clean record and a record of paying tax.

What is not confirmed

English language

A higher English standard is planned for settlement. In the information we reviewed, an upgrade to B2 level for settlement applications from 26 March 2027 has been signalled. Check the immigration rules and the Home Office guidance for the date that applies to you.

How to prepare now

  1. Keep records: payslips, tax records, tenancy agreements, and travel history.
  2. Check your English: book a test early if you may need B2.
  3. Avoid long absences that could break continuous residence.
  4. Stay informed: change in this area can arrive by statement of changes to the Immigration Rules, often with short notice.

Who should get advice

If you are close to a settlement milestone, on a dependant route, or have a gap in residence or work history, a regulated adviser (OISC or Solicitors Regulation Authority) can tell you how transitional rules affect you.

A note on rumours

Immigration policy attracts speculation. Treat only gov.uk and the Immigration Rules as authoritative.
